Previously the U.S. Supreme Court held in Batson v. We'll assume you're ok with this, but you can leave if you wish. Pursuant to the Supreme Court’s decision in Batson v. Kentucky, which prohibits the use of peremptory strikes on the basis of race, the defense objected to those strikes, and the burden shifted to the prosecution to prove that there were race-neutral explanation for the strikes.

At the first two trials, the prosecution used peremptory strikes on all qualified black prospective jurors. Two juries convicted Flowers and sentenced him to death. DISTRIBUTED for Conference of May 26, 2016.

In a third trial, Flowers was tried for all four murders, and a jury found him guilty and sentenced him to death.
